Acceptable Use Policy — binding rules on conduct and content for all FLEXR users

This is a translation provided for convenience. The German version is the legally binding one; if the two differ, the German wording prevails.
1. Scope
These community guidelines apply to all use of the FLEXR platform, operated by Julian Pachernegg, sole trader, Johann-Schrey-Weg 260, 8232 Grafendorf, Austria (see the legal notice). They supplement the terms and conditions and form part of the usage contract. A breach entitles us to block or delete the account, irrespective of any existing payment obligation. We deal with requests from authorities in accordance with our law enforcement guidelines.
2. Basic rules
- FLEXR is exclusively for persons aged 18 and over. The date of birth is checked server-side at registration; accounts under 18 are not created technically. Before an account is activated, the age is additionally checked manually against an official photo ID.
- One account per person. Accounts may not be shared, sold, rented out or operated for third parties.
- All details in the profile must be true and must relate to the person themselves.
- Every uploaded photo must show the registering person themselves. Photos of third parties, of celebrities, taken from the internet or of minors are not permitted.
- FLEXR is a platform for making contact, not a marketplace. Commercial offers, advertising, recruitment and brokerage of any kind are prohibited.
3. Prohibited content and conduct
The following are prohibited in particular:
- human trafficking, forced prostitution, sexual exploitation and any form of recruitment for these (section 4);
- all other criminal acts, in particular fraud, extortion, sextortion, drug and weapons trafficking, money laundering (section 5);
- impersonation, fake profiles, appearing in the name of another real or legal person (section 6);
- child sexual abuse material (CSAM) and any sexualisation of minors (section 7);
- harassment, stalking, threats, hate speech, discrimination;
- passing on other people’s personal data or third parties’ chat content without their consent;
- unsolicited sexually explicit images;
- commercial advertising, spam, redirection to external paid, cam, crypto or investment offerings;
- automated access (bots, scrapers) and evading blocks, for example by registering again after an exclusion.
4. Protocol: human trafficking and sexual exploitation
What is prohibited without exception
- offering, advertising, brokering or soliciting sexual acts in exchange for money or benefits with a monetary value;
- recruiting people for prostitution, cam offerings, “escort”, “sugar” or model agencies, including in the guise of a job offer;
- operating a profile for, or under the control of, another person (“carer”, “manager”, agency);
- any communication indicating coercion, debt bondage, withholding of identity documents, isolation or transport for the purpose of exploitation.
Detection
- Automated checking of public profile texts: bios containing links, phone numbers or relevant terms (including “escort”, “sugar daddy”, “sugar baby”, payment and crypto services) are rejected server-side on saving — the text is never published in the first place.
- Automated checking of chat messages: messages with the same signals are delivered, but flagged with a reason and placed in the moderation review queue. External links and email addresses are automatically masked for the recipient so that nobody can be steered to recruitment or payment pages outside the platform.
- Manual photo review: every photo is approved by a human before publication (section 7). Agency or studio shots with a promotional character are rejected in the process.
- User reports via the reporting function in the profile and the chat.
Procedure in a suspected case
- Immediate measure within 24 hours of becoming aware: the account is blocked, the profile is no longer visible to other users, and ongoing chats are stopped.
- Preservation of evidence: profile, photos, chat history and timestamps are preserved ahead of the deletion routine and withdrawn from further processing.
- Manual assessment by the operator on the basis of the preserved material.
- Where the suspicion is substantiated: report to the competent Austrian law enforcement authority (Federal Criminal Police Office, Central Service for Combating Human Smuggling and Trafficking) or to the police station at the operator’s seat. The account is permanently deleted.
- If there is a suspicion that a person is currently in danger, we notify the police emergency number 133 or 112 without delay.
- Affected users are pointed towards support services, in Austria in particular the intervention centre for victims of trafficking in women (LEFÖ-IBF) and the victim emergency line 0800 112 112.
5. Protocol: illegal acts
What is prohibited without exception
- fraud of any kind, in particular romance scams, advance-fee fraud, purported emergencies with demands for money, fake investment and crypto offerings, redirection to phishing pages;
- extortion and sextortion, i.e. threatening to publish intimate images;
- trading in narcotics, weapons, stolen data or forged documents;
- money laundering, passing on payments for third parties, misuse of the platform to initiate financial transactions;
- payment fraud against FLEXR, in particular the use of other people’s or stolen means of payment.
Detection
- server-side scam term checking in bios (hard rejection) and in chat messages (flagged for review);
- automatic removal of external links and email addresses from delivered messages — the typical route of scam attempts is thereby cut off;
- blocklist for disposable email addresses at registration;
- rate limiting on all security-relevant endpoints against automated bulk account creation and bulk messaging;
- payment processing exclusively via Stripe; FLEXR neither processes nor stores card details.
Procedure in a suspected case
- A report or system flag reaches the moderation review queue.
- Review of the flagged material within 72 hours, without delay where there is imminent danger.
- Graduated measure: temporary chat suspension for a one-off, less serious breach — immediate account block for attempted fraud, extortion or trafficking.
- Preservation of evidence and a report to the criminal police where there are initial grounds to suspect a criminal offence.
- Users who have suffered harm receive, on request, the data relating to their case for a report of their own, in so far as data protection law permits.
6. Protocol: impersonation and fake profiles
What is prohibited without exception
- appearing under the name, with the photos or with the identity of another real person, of a company or of an authority;
- using photos belonging to others, generated photos or photos taken from the internet;
- false statements about age, gender, place of residence or gym, in so far as they serve to deceive other users;
- creating second or replacement accounts, in particular after a block.
Preventive measures
- Photo requirement: without at least one approved photo, a profile is not visible to others.
- Manual approval: every uploaded photo is initially “pending” and is only delivered after human review.
- Mandatory age and identity check: the server requires a selfie taken live with the camera — an existing image from the gallery cannot be selected for it. In addition there is a one-off image of an official photo ID. A human compares the profile photos, the selfie and the ID photo and cross-checks the date of birth — without automated facial recognition. Only once the check has been passed is the account activated and the profile given the verification tick; the selfie and the ID captures are then deleted from storage.
- Email uniqueness per account and a blocklist for disposable addresses.
Procedure on a report
- Report via the reporting function or by email to flexr.social@proton.me. People whose identity is being misused can report this even if they do not have a FLEXR account themselves.
- Review within 72 hours. Photos that have been objected to are withdrawn from delivery for the duration of the review.
- Where the suspicion is well founded, we request photo verification in accordance with the procedure described above.
- If it is not provided within seven days or does not pass the check, the photos are removed and the account is blocked.
- In cases of commercial or repeated impersonation, the account is permanently deleted and, where there are indications of fraud, reported to the authorities.
7. Protocol: protection of minors and CSAM
What is prohibited without exception
- any depiction of child sexual abuse (CSAM) in profile photos, chat messages or profile texts;
- any sexualisation of minors, including in text, drawing, comic or AI-generated form;
- initiating sexual contact with minors (grooming) and requesting or offering corresponding content;
- use of the platform by persons under 18;
- uploading photos in which minors are recognisably depicted — including incidentally or in a family photo.
Preventive measures
- Age limit enforced technically: registration requires a date of birth; the server rejects any value below 18 years. Age is continuously calculated from the date of birth rather than held as a freely editable number. Before activation, a human additionally checks the date of birth against an official photo ID presented; if it does not match the statement made at registration, or if it is below 18, the account is not activated.
- Full pre-moderation of all images: no photo is delivered to other users without manual approval. Where there is doubt about whether the person depicted is of age, the photo is rejected and the account reviewed — in case of doubt, against approval.
- No image sending in the chat: the chat transmits text only. The distribution of image material via the platform is thereby limited to the pre-moderated profile area.
- No photos of third parties: only photos showing the registering person themselves are permitted.
Procedure where CSAM or a minor’s account is suspected
- Immediate removal of the content from delivery and immediate blocking of the account — without a prior hearing and without a waiting period.
- Preservation of evidence: the material is locked against automatic deletion, access is restricted to the operator and it is retained solely for handover to law enforcement. It is not viewed further, copied or distributed.
- Report within 24 hours of becoming aware to the Austrian authorities: Federal Criminal Police Office, reporting office for child pornography and child sex tourism, and a report to the criminal police. Where a child is in immediate danger, the police emergency number 133 or 112 is also called immediately.
- Permanent deletion of the account. Renewed access is refused permanently.
- Where an account is operated by a minor, the account is blocked and deleted; the data is retained only for as long as is necessary to comply with an official order.
- Reports in this area have absolute priority in the review queue over all other matters.

8. Enforcement

The measure depends on severity, intent and repetition. In the cases named in sections 4 and 7 there is no graduation: the account is blocked immediately.
9. Reporting, decision and objection
The reporting procedure is designed around Art. 16 of Regulation (EU) 2022/2065 (Digital Services Act, DSA): reporting is done electronically, every report is acknowledged, and the reporter is told what came of it.
Reporting
- In the app: reporting and blocking functions in every profile and every chat. Blocking takes effect immediately and both ways.
- By email: flexr.social@proton.me, including without an account of your own — for example where your own identity is being misused here. A profile name, a time and a brief description are helpful.
What happens next
- Acknowledgement of receipt immediately: every report is given a reference number on submission, which is displayed in the app.
- Review within 72 hours — without delay, and at the latest within 24 hours, where there is imminent danger and in the cases covered by sections 4 and 7. The review is carried out by a human; no automated process decides on a block.
- Decision with reasons: under “My reports” in the account area, each report states whether we took action or could not find a breach — together with the reasons in full.
- Objection: anyone who disagrees with the decision can object to it informally by email. We review the matter again and respond with reasons.
If we take action against your account
Under Art. 17 DSA you receive a statement of reasons for every restriction. In the case of a temporary chat suspension it appears in the chat; in the case of an account block it appears when you try to sign in. Both state the reason, the duration and how to object: informally by email to flexr.social@proton.me. We then review the decision again and respond with reasons. Your right to take legal action remains unaffected, as does the possibility of turning to the Austrian supervisory authority for digital services (Digital Services Coordinator at KommAustria/RTR).
Automated checking and human control
The only things that run automatically are the filters described in sections 4 to 7: they reject profile texts, mask links and contact details in messages and submit conspicuous messages to moderation. Every measure beyond that — photo approval, chat suspension, account block, deletion — is taken by a human.

The same address is at the same time the single point of contact for users under Art. 12 DSA and the single point of contact for authorities under Art. 11 DSA. Communication takes place electronically by email, in German or English. For the procedure for official requests, see the law enforcement guidelines.
FLEXR is run as a micro enterprise within the meaning of Recommendation 2003/361/EC and is therefore exempt under Art. 19 DSA from the additional obligations for online platforms (Section 3 of Chapter III) — such as the internal complaint-handling system under Art. 20 and the reporting obligation under Art. 24.
That exemption does not cover all DSA obligations. The obligations for providers of intermediary and hosting services apply regardless of size, and we meet them as described above:
- Art. 11 — single point of contact for authorities;
- Art. 12 — single point of contact for users;
- Art. 14 — comprehensible information on restrictions in the terms and conditions and the community guidelines;
- Art. 16 — notice and action procedure, see section 9 and the public form at flexr.social/en/meldung.html;
- Art. 17 — statement of reasons for every restriction;
- Art. 18 — notification to the authorities of suspicion of certain criminal offences.
The classification as a micro enterprise is based on the operator’s own information and is kept under review. If it ceases to apply, the obligations of Section 3 apply after the twelve-month transitional period under Art. 19(1) DSA, unless FLEXR is classified as a very large online platform before then. We will implement the additional obligations in good time and amend this section.
